Our general terms and conditions of sale are as follows:

1. OBJECT

The terms and conditions apply exclusively to the online sale of products available on the website www.bohosoleil.com, which is open to the public.

2. DOMAIN OF APPLICATION

These General Terms and Conditions of Sale (GTC) govern exclusively online sales contracts for Bohosoleil products concluded with buyers acting as consumers, and together with the online order, constitute the only contractual documents binding on the parties.
All other documents such as brochures, catalogs, or product photographs are expressly excluded, as they are for illustrative purposes only.

The general terms and conditions apply exclusively to sales of products delivered to consumers established in France or internationally.

The applicable terms and conditions, as well as all contractual information appearing on the site, are written solely in French.

3. AVAILABILITY OF THE TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale are made available to the consumer on the website www.bohosoleil.com where they can be freely consulted at any time.

By ticking the box provided for this purpose during the ordering process, the consumer acknowledges having read and accepted these Terms and Conditions without reservation.

Confirmation of the order constitutes full and complete acceptance of these General Terms and Conditions of Sale, in effect on the date of the order. These terms and conditions prevail over any other document, unless otherwise agreed in writing.

Their preservation and reproduction are ensured by the professional seller, in accordance with Article 1127-2 of the Civil Code.

4. COLLECTION AND USE OF PERSONAL DATA

To manage your orders and improve our service, we collect certain personal data when you make a purchase on our site. This includes information such as your name, email address, delivery address, and order details.

5. PRODUCTS

5.1 Characteristics

The products for sale presented in the catalog published on the website are each accompanied by a description outlining their essential characteristics as defined in Article L.111-1 of the French Consumer Code.
The photographs illustrating the products are not contractual documents.

6. PRIX DE VENTE

6.1 Displayed price

In accordance with Article L.112-1 of the Consumer Code, the selling prices are indicated, for each of the products listed in the electronic catalogue, in euros inclusive of all taxes, excluding delivery and transport costs mentioned before validation of the order and charged in addition.

The total amount due by the consumer is shown on the order confirmation page.

The product’s selling price is the price in effect on the date of the order.
The selling price does not include shipping costs, which are charged separately.
In the event of a price promotion, the seller agrees to apply the promotional price to all orders placed during the promotional period.

6.2 Modification

The professional seller reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.

6.3 Additional Costs

Additional transport, delivery or postage costs, which the consumer was able to review before ordering, are specified on the order form.

6.4 Promotional prices and discounts

When the seller displays a promotional price or a price reduction, this is calculated on the basis of the lowest price charged during the thirty (30) days preceding the start of the promotion, in accordance with the provisions of Article L.112-1-1 of the Consumer Code.

This rule applies to any offer publicly visible on the site, including in particular sales campaigns, temporary discounts, flash sales or commercial operations displaying a crossed-out price or a percentage discount.

6.5 Promotional offers and discount codes

Promotional codes, including those from collaborations or affiliate operations, cannot be combined with each other or with other ongoing promotions, unless expressly stated otherwise.

The seller reserves the right to define a minimum purchase amount for their application (for example, €100 including VAT), as well as to exclude them from certain products or commercial periods.

In the event of improper use, the seller may cancel the order or deactivate the code in question, without compensation.

7. ORDER

Consumers can place orders directly on the website www.bohosoleil.com.
The ordering process includes the following steps:

• Select the product(s)
• Add to cart
• Confirm your cart
• Enter your contact information and choose your delivery method
• Secure payment

Before confirming the order, the consumer can check the details of their basket and its total price, and correct any errors.

The order is considered final after payment confirmation.
A confirmation email is automatically sent to the email address provided by the customer.

Order confirmation implies full and complete acceptance of these Terms and Conditions.

7.1 Limitation of abnormal or suspicious orders

The seller reserves the right to refuse or cancel any order that is abnormal in quantity or frequency, or that suggests professional, fraudulent or unauthorized use.
Such a decision may be taken without prior notice or compensation, provided that the consumer’s behavior does not correspond to reasonable use expected of an end consumer.

8. PAYMENT

8.1 Exemption

The price is due in full upon order confirmation. Payment is made immediately upon ordering by credit card or PayPal.

To offer more flexibility, the Customer can pay for their purchases via Klarna.

• Immediate payment: Payment in a single installment via Klarna.
• Deferred or installment payment: Depending on the amount and country of residence, Klarna may offer payment in 3 or 4 installments (often free of charge) or a payment deferral.

Conditions :

o Eligibility for installment payments is determined directly by Klarna at the time of order.
o Bohosoleil has no control over this decision and cannot be held responsible for a financing refusal.
o The Customer must accept Klarna’s General Terms and Conditions, available at www.klarna.com.

• Contractual relationship: the potential credit agreement is concluded exclusively between the Client and Klarna.

The order is considered final only after payment has been validated by Klarna.

8.2 Payment Security

The website features a secure online payment system that allows consumers to encrypt the transmission of their bank details via the secure payment platform’s server. At no time does the consumer’s bank information pass through the seller’s computer system.

8.3 Payment terms / incidents

In the event of a refusal of payment authorization by the banking institution or a payment incident, the seller reserves the right to suspend or cancel the order.

Any fraud or attempted fraud may be subject to legal proceedings.

9. DELIVERY

Delivery is understood to mean the transfer to the consumer of physical possession of the goods.

9.1 Delivery charges

Delivery with signature via Colissimo, Chronopost or Mondial Relay is offered in several options depending on the destination chosen for the orders:

• Metropolitan France and Monaco: Free standard delivery (2 to 4 business days) or delivery to a pickup point (3 to 5 business days). Express delivery available in 1 to 2 business days (€10).
• European Union: Standard delivery in 2 to 8 business days (€5) or express delivery in 1 to 3 business days (€15).
• Switzerland: Express delivery in 1 to 3 business days (CHF 30).
• French Overseas Departments (Réunion, Mayotte, Guadeloupe, Martinique, French Guiana): Express delivery in 3 to 5 business days (€69).
• French Overseas Territories (Saint Barthélemy, Saint Martin, Saint Pierre and Miquelon, New Caledonia, French Polynesia, Wallis and Futuna): Express delivery in 5 to 10 business days (€119).
• United States: Express delivery in 1 to 3 business days ($40).

The indicated delivery times are estimates and may vary depending on the carrier or exceptional circumstances (customs, holidays, etc.).

Regarding the purchase of products delivered by our service providers, the delivery costs are indicated in the shopping cart at the time of purchase.

9.2 Shipping Time

Under normal conditions, orders are prepared within an estimated 2 to 3 working days from their validation, excluding weekends and public holidays, and subject to product availability.

These delivery times are indicative and may vary depending on order volume, the period or exceptional circumstances.

9.3 Delivery time

Once shipped, the order is handed over to La Poste (Colissimo, Chronopost) or Mondial Relay, at the customer’s choice.
Delivery time is estimated between 2 and 6 business days for mainland France and Belgium.
Delivery times for international orders vary depending on the destination, customs, and the local carrier.

These delivery times are provided for informational purposes only. The seller cannot be held responsible for any delays beyond their control (carrier delays, force majeure, logistical blockages, etc.).

The consumer agrees to facilitate the delivery of the package (visible name, access information, telephone number, etc.).

9.4 Delivery Delay

In the event of a significant delay, the consumer is advised to contact customer service so that an investigation can be opened with the carrier.

In accordance with Article L.216-2 of the Consumer Code, if delivery has not taken place within thirty (30) calendar days from the date of the order, the Customer may demand termination of the contract and obtain a full refund of the sums paid.

9.5 Delivery Location

The products are delivered to the address indicated by the consumer on the order form.

9.6 Package receipt and anomaly

Any anomaly (damaged or opened package, missing product, incorrect reference, etc.) must be reported within a maximum of 48 hours by email to our customer service at: contact@bohosoleil.com, with supporting photos.

After this period, we cannot guarantee the processing of the claim with the carrier nor hold them liable. If no claim is made within this period, the delivery will be deemed compliant, without prejudice to the legal guarantee rights provided for in Article 10.

9.7 Delivery outside the EU

For any delivery outside the European Union, the consumer is solely responsible for the payment of any customs duties, local taxes or other import fees that may be payable.

10. PRODUCT AVAILABILITY

Products are offered and delivered subject to availability.
If a product ordered is unavailable, the seller will immediately inform the consumer and may offer a product of equivalent quality and price or, failing that, a voucher for the amount of the order, valid for any future purchase.
If the consumer does not agree to this, the seller will refund the sums paid within 30 business days.
Apart from the refund of the price of the unavailable product, the seller is not liable for any cancellation compensation, unless the non-performance of the contract is directly attributable to them.

11. PRODUCT CONFORMITY AND TRANSFER OF OWNERSHIP

11.1 Product Conformity

Bohosoleil guarantees the authenticity of its products.

In the event of a proven non-conformity, the seller undertakes, as appropriate, to repair or replace the product at no additional cost to the consumer, within a reasonable timeframe.

11.2 Transfer of Ownership

Ownership of the products is transferred to the consumer only after full and effective payment of the price, including the principal and any additional charges.

In accordance with the provisions of Article L.216-4 of the Consumer Code, the risks associated with the products (loss, theft, damage) are transferred to the consumer at the time of delivery to the consumer or to a third party designated by him.

12. PRODUCT RETURNS AND RIGHT OF WITHDRAWAL

In accordance with Articles L.221-18 et seq. of the Consumer Code, the consumer has a period of fourteen (14) calendar days from the receipt of his order to exercise his right of withdrawal, without having to justify reasons or pay penalties, with the exception of return costs, which remain his responsibility.

The right of withdrawal can be exercised:

• Either by filling out the contact form on www.bohosoleil.com.
• Or by any other clear and unambiguous written means, including email to: contact@bohosoleil.com.

The seller will promptly send an acknowledgement of receipt of the withdrawal on a durable medium (for example, by email).

Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.), allowing for their resale as new. Any damaged, incomplete, used, or opened product will not be refunded.

In the event of a valid exercise of the right of withdrawal, all payments received (excluding return costs) will be refunded via the same payment method used for the order, within a maximum period of fourteen (14) days from the effective receipt of the returned products.

In accordance with Article L.221-24 of the Consumer Code, the seller reserves the right to defer the refund until physical receipt of the package and verification of compliance with the return conditions (unopened, unused, complete product).
No proof of shipment can replace the actual receipt of the product.

The seller also reserves the right to refuse any clearly abusive return request, particularly in cases of repeated use of the right of withdrawal solely to obtain a product without obligation.
The right of withdrawal must be exercised in good faith, in accordance with its purpose as defined by law.

12.1 Partial Return – Exclusion

Reimbursement under the right of withdrawal is conditional upon the complete return of the product.

The seller does not accept any partial returns.

The product must be returned in its entirety, including all original parts and accessories.

Any incomplete, opened, used or damaged return will be automatically refused and will not be eligible for a refund.

13. REFUND POLICY (EXCLUDING THE RIGHT OF WITHDRAWAL)

Defective or damaged product upon receipt:
Any visible damage must be reported as soon as possible, ideally within forty-eight (48) hours of receipt.
In accordance with Articles L.217-3 to L.217-7 of the French Consumer Code, any lack of conformity may be reported for a period of two (2) years from the date of delivery.

Product not as ordered:
In the event of a proven error with the delivered product (incorrect model, missing accessory, etc.), the seller will cover the return shipping costs and will offer the consumer the choice of either sending a replacement of the correct product or a full refund.

Undelivered or lost package:
In accordance with Article L.216-2 of the Consumer Code, if the order is not received within thirty (30) calendar days of the order date, and after written notification from the consumer, the seller will offer to reship the order or provide a full refund.

These provisions apply without prejudice to legal guarantees, in particular the guarantee of conformity provided for in Article 10.

14. CONDITIONS OF RESALE AND REFURBISHMENT

Products sold on the site may not be resold or repackaged for commercial or professional purposes without the prior written consent of Bohosoleil.

This restriction does not apply to consumers acting in a private capacity, who retain the freedom to resell products acquired for personal use, particularly on peer-to-peer platforms.

Any resale or reconditioning carried out in violation of this clause may be subject to prosecution, in particular for unfair competition or infringement of trademark rights.

15. MODIFICATION OF THE TERMS AND CONDITIONS OF SALE

These Terms and Conditions were last updated on September 20, 2025.
The seller reserves the right to modify these Terms and Conditions at any time.

In the event of changes to the General Terms and Conditions, the applicable General Terms and Conditions are those in force on the date of the order, a dated copy of which can be provided to the consumer upon request.

16. GENERAL CLAUSES, NULLITY AND INAPPLICATION

The invalidity of a contractual clause does not render the General Terms and Conditions invalid. The temporary or permanent non-application of one or more clauses of the General Terms and Conditions by the professional seller cannot constitute a waiver by the seller of the other clauses of the General Terms and Conditions, which remain in full force and effect.

17. ARCHIVING AND EVIDENCE

Communications, purchase orders, and invoices are archived on a reliable and durable medium to create a faithful and lasting copy in accordance with Article 1360 of the French Civil Code. These communications, purchase orders, and invoices may be used as evidence of the contract. The data recorded by the seller and its payment providers is considered valid between the parties and constitutes proof of financial transactions.

18. DISPUTE RESOLUTION

The seller shall not be held liable for damages resulting from improper, inappropriate or non-compliant use of its products, within the limits provided by applicable legislation.

This limitation of liability does not apply in the event of a breach of the seller’s legal obligations, in particular with regard to product safety, conformity or personal injury related to a defect.

The seller shall not be liable for any indirect, intangible or consequential damages resulting from the use or misuse of the products sold.

In any event, the seller’s liability, for all causes combined, shall not exceed the total amount of the order in question.

This limitation does not apply in cases of gross negligence, willful misconduct, or personal injury caused by a product defect.

19. EXTREME CASE

The seller cannot be held responsible for any failure to fulfill its contractual obligations in the event of an occurrence constituting force majeure, as defined in Article 1218 of the Civil Code.

The following are considered force majeure events, without this list being exhaustive: natural disasters, fires, floods, pandemics, epidemics, armed conflicts, acts of terrorism, strikes affecting postal services or means of transport, interruptions of telecommunications networks, administrative or governmental decisions, or any other unforeseeable, irresistible and external event making it impossible to perform the contract.

In the event of force majeure, the execution of the seller’s obligations will be suspended for the entire duration of the event, without this giving rise to any compensation.

20. NON-WAIVER

The fact that the seller does not invoke any of the clauses of these General Terms and Conditions of Sale at any given time shall not be interpreted as a waiver of the right to invoke them subsequently.

21. PROCESSING OF PERSONAL DATA

The personal data collected on the seller’s website is processed in accordance with applicable regulations and our privacy policy.

21.1 Transfer of data outside the European Union

Some of our technical service providers (hosting, e-commerce platform, email service, analytics tools, or social networks) may be located outside the European Union, particularly in the United States.
In this case, the seller ensures that these transfers are governed by appropriate safeguards, such as:

• Standard contractual clauses approved by the European Commission,
• Or an adequacy decision taken by the Commission for the country concerned.

These measures aim to guarantee a level of protection equivalent to that required within the European Union, in accordance with Articles 44 et seq. of Regulation (EU) 2016/679 (GDPR).

22. CUSTOMER RATINGS AND REVIEWS

After their purchase, customers may be contacted by email to leave a review of their experience and the products received. The seller only publishes verified reviews, collected after a genuine purchase or authenticated interaction. In accordance with the recommendations of the DGCCRF (French Directorate General for Competition Policy, Consumer Affairs and Fraud Control), no reviews are modified, deleted, or purchased. Reviews deemed fraudulent or non-compliant may be moderated.

23. ELECTRONIC COMMUNICATIONS

The consumer expressly agrees that communication with the seller will primarily take place electronically (email). These communications have the same legal value between the parties as postal mail.

24. RETENTION OF TITLE

The work remains the property of Bohosoleil until full payment of the price.

25. INTELLECTUAL PROPERTY

The purchase of the artwork does not grant the buyer any right to reproduce or exploit it. Copyright and moral rights remain the exclusive property of the seller or the artist concerned.

26. APPLICABLE LAW AND LANGUAGE OF THE CONTRACT

These General Terms and Conditions of Sale are governed by French law. They are written in French. In the event of a translation, only the French version shall prevail between the parties.

Any dispute relating to their formation, validity, interpretation or execution shall, in the absence of an amicable settlement, fall under the exclusive jurisdiction of the territorially competent French courts, even in the case of multiple defendants or third-party claims.
